- The customer warrants, represents and agrees that any advertising material provided by
customer to the Elsbi Group Ltd:
5.1. Are in compliance with all applicable laws;
5.2 Will not infringe any intellectual property or
personal right held by any person;
5.3 Is not false, misleading or deceptive.
- The customer will transfer and unconditionally assign the Elsbi Group all copyright
associated with the advertising.
- The customer will not hold the Elsbi Group Ltd. responsible for any losses, liabilities,
damages, costs and expenses incurred directly or indirectly by Elsbi Group Ltd.
- Failure to comply with copyrights, property rights or other lawful requirements to which
the Elsbi Group Ltd. is subject to will result will in a liability for Elsbi Group
Ltd..
- Elsbi Group Ltd will not be responsible or liable if the publication of the
advertisement is delayed or interrupted
beyond the usual or expected date or periods.
- Both parties agree that sending an E-mail message without return confirmation does not
guarantee successful
receipt by the other party
- To the extent permitted by law, neither party is liable for any consequential,
incidental, indirect, economic or
punitive damages incurred by the other party even if the other party has been advised that
such damages are possible.
- If the placement of an advertisement on the Internet is disrupted due to technical
reasons or other reasons
beyond Elsbi Group Ltd control, Elsbi Group Ltd will be responsible for insuring that the
advertisement is placed on an alternative website or extend the advertisement
duration for a period of at least as long as the duration of
the interruption or the remaining prepaid period, whichever is the case.
